All rules set forth for the Race the Night HK have been established in order to protect the safety of our participants. Your cooperation is greatly appreciated in helping everyone to enjoy race day.

General

  1. These are the terms and conditions (“Terms and Conditions“) that apply to the Race the Night HK 2019, to be held in Hong Kong on 18 May 2019 (“Race the Night HK“), details of which are further set out at racehk.com/night/ (the “Race the Night HK Site”). By registering to participate in the Race the Night HK or to sponsor a participant by making a pledge, you agree to be bound by these Terms and Conditions.  If you do not accept these Terms and Conditions, you must not register to participate in the Race the Night HK or sponsor a participant by way of a pledge (“Sponsor”)
  2. Specific rules relating to the Race the Night HK are displayed on the Race the Night HK Site (the “Rules“) and are incorporated herein. In the event of a discrepancy between these Terms and Conditions and the Rules, the Rules shall prevail. If you do not accept the Rules, please do not participate in the Race the Night HK.
  3. The Organizer of Race the Night HK is Sporting Republic (“Organiser”). The Organiser reserves the right to amend the Rules and/or these Terms and Conditions at any time without prior notice. Any changes will be posted either within the Rules or these Terms and Conditions.
  4. In the event of any dispute regarding the Terms and Conditions, Rules, the conduct of the Race the Night HK, results, pledges, sponsorship and any other matter relating to the Race the Night HK the decision of the Organizer shall be final and no correspondence or discussion shall be entered into.

Eligibility, Registration & Participation in Race the Night HK

  1. The minimum age requirement for the 10K race is 16 years old on the event day. The minimum age requirement for the 5K race is 12 years old on the event day. There is no minimum age requirement for the 3K race. A child under 10 years old must be accompanied by 1 parent/guardian aged 18 or above. The Event Organizer has the right to verify the ages of participants before, on and after the event. To enter, you must register online via the Race the Night HK Site, by 11:59 p.m. (Hong Kong Time) on 5 May 2019 and comply with all applicable conditions. All entrants who complete the online registration to participate in the Race the Night HK and whose applications are accepted by the Organizer shall be referred to as “Participants”.
  2. To register, you must provide your full name, gender, a valid telephone contact number, address, date of birth, a valid contact email address and the details of your emergency contact as well as any further information that the Organizer or its designee may from time to time request. You agree and warrant that you will provide complete, accurate and up-to-date information as required.
  3. All Participants who are under the age of 18 on the event day will only be accepted to participate in the Race the Night HK if they have submitted the Parent/Guardian consent during on-line registration, in accordance with the Organizer instructions. No entries will be accepted without the acceptance of any on-line registration made by a person under 18 years of age is conditional upon the Organizer’ receipt of a Waiver & Release Declaration duly agreeed by that person’s parent or guardian.
  4. All Participants (or, if under 18 years old, their parents/guardians) will be required to agree the Waiver and Release Declaration specified by the Organizer. The Waiver & Release Declaration must be agreed upon registration. For participants under 18 years old, the Waiver & Release Declaration must be agreed by Parent/Guardian.
  5. Registration for participation in the race is only confirmed upon the successful completion of the race entry form, payment of the Registration Fee and Donation and issuance of a unique registration ID number.
  6. On the day of the Race the Night HK, Participants must arrive at the run site at least 45 minutes before your race start time (or as otherwise advised by the Organizer). Participants may not be permitted to run if they fail to do so.  The Organizer reserves the rights for not permitting the late-comers to join the race.
  7. Each Participant will be provided with an official race number, which MUST be worn on the front of their shirt and be visible at all times during the event.  The race number may not be exchanged, transferred or sold to any other person.
  8. Participants must comply with all further rules and regulations that apply at the event site as may be notified by the Organizer or its designee.
  9. The Organizer reserves the right to cancel, postpone or change the venue, date and time of Race the Night HK.
  10. In the event of inclement weather including, without limitation hoisting of a typhoon signal no. 3, amber rainstorm, red rainstorm, black rainstorm, thunderstorm and/or landslide warning, the Organizer reserve the right to delay the commencement of the Race the Night HK, or cancel Race the Night HK.
  11. Whilst every reasonable precaution will be taken by the Organizer to ensure the safety of the Participants, all Participants run at their own risk and are responsible for their own safety
  12. For safety reasons, pets, bicycles, in-line skates, prams, push carts, shoes with in-built or attached rollers or any other wheel-run objects will not be permitted on the course.
  13. The Organizer reserves the right to disqualify or exclude any person from the Race the Night HK and withhold any relevant awards if they have reasonable grounds to believe the Participants has breached any of these Terms and Conditions and/or the Rules.
  14. Eligibility may change for regulatory reasons in which case the Terms and Conditions shall be amended accordingly. You agree that the Organizer shall not be held liable in the event that any persons are subsequently excluded from Race the Night HK as a result of any regulatory direction or applicable law.

Registration Fee and Donations

  1. To be eligible to participate in the Race the Night HK, every entrant is required to (i) pay an entry fee and (ii) minimum donation.
  2. The entrants and Participants acknowledge and agree that by submitting their registration application for the Race the Night HK, the Registration Fee and Donation are strictly non-refundable and non-transferable.

Awards

  1. Race the Night HK is non-competitive.
  2. However, awards will be given based on the registration category, age and runtime (“Awards”). The Award categories and details of the points system are set out at the event website.
  3. The nature and allocation of each Award are subject to change and entirely at the discretion of the Organizer.
  4. In all matters relating to the Awards, the decision of the Organizer shall be final and binding. No correspondence or discussion shall be entered into.
  5. Awards will be announced by the Organizer at the event site, after the Race the Night HK.
  6. Awards are non-transferable and there is no cash alternative.
  7. Awards are given on an “as is” basis without warranty of any kind from the Organizer, express or implied, save where this would be contrary to applicable law. Actual awards given by the Organizer, and any of its sponsors, may differ from those shown anywhere on the Race the Night HK Site, Rules or during the Race the Night HK. Participants shall not make any claims or demands in this regard. The Organizer will not be liable in the event that any and all Awards or part of any Award is unable to be delivered or fulfilled.

Liability

  1. The Organizer will assume (and by registering as a Participant you warrant) that either you have legal capacity to enter into the agreement set out in the Rules and these Terms and Conditions (i.e., that you are of sufficient age and mental capacity and are otherwise entitled to be legally bound in contract) or, if you are under 18 years of age, that your parent or guardian has consented to your registration and/or sponsorship and accepts these Terms and Conditions on your behalf.
  2. By registering as a Participant, you:
    – warrant that you have read and understood these Terms and Conditions and the Rules and agree to be bound by them; and
    – warrant that all information submitted by you is true, accurate, current and complete.
  3. The Organizer does not accept responsibility or liability for any failure to receive entries or pledges whether caused by any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, server functions, virus, bugs or otherwise.
  4. To the maximum extent permitted by applicable law, the Organizer shall not be liable for any damage, loss, injury or disappointment suffered by any Participant participating in the Race the Night HK or associated activities (including the pledges) or as a result of inability to participate in the Race the Night HK, or the acceptance or use of any Award. The Organizer is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to Participant’s or any other person’s computer or mobile telephone related to or resulting from registration for or participation or downloading any materials related to the Race the Night HK.
  5. By registering either to participate in the Race the Night HK or make a Donation, Participants and Sponsors agree that no claim shall be asserted against the Organizer or any subsidiary or associated company of the Organizer, their affiliates, directors, officers, employees or agents for any and all losses, damages, rights, claims and actions of any kind (including special, indirect and consequential losses) resulting from registration for, participation in, inability to participate in the Race the Night HK or make Donations, or acceptance or use of any Award.

Indemnity

  1. To the maximum extent permitted by applicable law, you agree to indemnify and keep indemnified the Organizer, their officers, directors, employees, agents, distributors and affiliates from and against any and all claims, loss, damage or liability suffered and fees and costs incurred, including reasonable legal fees, resulting from any act, neglect or default or breach by you or any person who may be authorized by you or for whom you are responsible, of any of these Terms and Conditions and/or from your placement or transmission of any content onto the Organizer servers and/or from any and all use of your account.

Publicity & Data Protection

  1. By Participating in the Race the Night HK and/or acting as a Sponsor, you agree that the Organizer may use your name and address, photographs and audio and/or visual recordings of you in any publicity or promotional material as the Organizer may in their sole and absolute discretion decide.
  2. The personal information and data that the Organizer collects from you in respect of your registration as a Participant and/or Sponsor will be used by the Organizer for the purposes for which it is given i.e. for the administration of your participation in the Race the Night HK (whether as Participant or Sponsor). The Organizer may also use the information to conduct research or analysis aimed at improving our services and technologies; profiling users when pitching for sponsorship, improving our customer service standards and personalizing the content you see on the Race the Night HK Site.
  3. The Organizer may also use your personal information to send newsletters, promotional materials and updates to inform you of similar initiatives available from the Organizer.
  4. Any personal information collected through the Race the Night HK Site may be stored and processed in Hong Kong or any other country in which the Organizer or our affiliates, subsidiaries or service providers.
  5. Unless otherwise stated herein we will not disclose your personal information outside of the Organizer and their subsidiaries and affiliates without your consent.
  6. The Organizer may engage third party service providers to provide services on our behalf such as processing and delivery of mailings, web hosting, processing transactions, customer support and research and statistical analysis. These service providers will only be allowed to access personal information to the extent required to perform their specific services. All service providers will be required to treat personal information strictly as confidential information.

Intellectual Property

  1. You acknowledge and agree that all copyright and trademarks and all other intellectual property rights related to Race the Night HK including in the Race the Night HK Site and all material or content contained within it shall remain at all times owned by the Organizer or their licensors. All material and content contained within the Race the Night HK Site is made available for your personal non-commercial use only and may not be reproduced or retransmitted without the express written consent of the Organizer. You acknowledge and agree that where it is necessary for you to download, print or copy any such materials either from the Race the Night HK Site or as provided by the Organizer, you are only permitted to do so for your own personal use and you may download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content on the Race the Night HK Site is strictly prohibited.

Governing Law

  1. The Rules and the Terms and Conditions shall be governed in all respects by the laws of the Special Administrative Region of Hong Kong.
  2. In the event of any inconsistency between the English language version of these Terms and Conditions for Participants and Sponsors and the Chinese translation of the same, the English language version shall prevail.
